1. Who we are
TRAK LLC (“TRAK,” “we,” “us” or “our”) operates trakgrowth.com. TRAK is co-owned by Jamal Moubarak and Ken Frommert. Our promise is simple: One Partner. More Ways to Grow. This Privacy Policy applies to information we collect through trakgrowth.com, its service sections listed below, and related communications with us. Some services may provide additional notices, terms or agreements; where they do, those documents also apply.

3. Information we collect
Information you give us

- Merchant applications (Trak Payments): legal and DBA business name, entity type, last four digits of the EIN, industry, years in business, locations, business address, website and email; owner name, title, ownership percentage, email, phone and address; and processing details such as current processor, monthly card volume, average and high ticket, transaction counts, card-present/card-not-present mix, chargebacks, prior account terminations, equipment and technology needs.
- Lending applications (Trak Payments): similar business and owner information, plus amount requested, use of funds, annual revenue, monthly deposits and card volume, self-reported credit range, existing financing and monthly obligations, bankruptcy and tax-lien history, and any background you provide.
- Account and service information: if you sign in to or use a TRAK service (such as Trak Marketing or Fluid AI), the information needed to provide that service, such as login details, account settings, and content you or your business provide.
- Communications: emails, calls and messages you exchange with us.
Information collected automatically
Like most websites, our web servers automatically record standard request information, such as IP address, browser and device type, pages requested, referring page, and date and time. We use this for security, troubleshooting and operating the site.
Information from others
We may receive information about an application’s status or outcome from processors, banks, gateways or funding providers you ask us to work with, and information our business customers provide to us so we can deliver services to them.
4. Cookies & analytics
As of the effective date, the trakgrowth.com hub, Trak Payments and Pitch LED pages do not use third-party analytics, advertising pixels or tracking cookies, and do not load third-party scripts or fonts. Fonts and images are served from our own servers. Signed-in services may use cookies or similar storage that are strictly necessary for login sessions and security. If we add analytics or advertising tools in the future, we will update this policy and, where required, ask for your consent.
5. How we use information
- Respond to inquiries, project requests and applications.
- Evaluate and help you obtain payment-processing, business-funding or other requested services.
- Provide, operate, support and improve our services, including Trak Marketing and Fluid AI.
- Communicate with you about your request, account or service, and—where permitted—about TRAK services that may interest you.
- Maintain security, prevent fraud and spam (our forms include anti-spam measures), and protect our rights and users.
- Comply with law, regulation, card-network rules and legal process.
We do not sell personal information, and we do not share it for cross-context behavioral advertising.
6. How we share information
- Payment processors, acquiring banks, gateways and funding providers. When you submit a merchant or lending application and authorize us to do so, we share your application with prospective processors, acquiring banks, gateways, lenders and related service providers as reasonably necessary to evaluate your request. Payment processing is performed by these third-party processors and banks, not by TRAK, and their use of your information is governed by their own privacy notices and agreements. Those providers may require additional authorizations before obtaining credit reports, bank data or other sensitive information. Submitting an application does not guarantee approval of any product.
- Service providers that help us operate, such as web hosting, email, telephony, cloud storage, and AI or speech-processing providers, who may use information only to perform services for us.
- Legal and safety. When we believe disclosure is required by law, subpoena or other legal process, or is necessary to protect the rights, property or safety of TRAK, our customers or others, or to prevent fraud.
- Business transfers. In connection with a merger, acquisition, financing or sale of assets, subject to this policy.
- With your consent or at your direction.
7. Calls, recordings & AI notice
Fluid AI provides an AI call attendant to businesses. When you call a business that uses Fluid AI, your call may be answered by an automated AI agent rather than a person, and the call may be recorded and transcribed. Information from the call—such as your phone number, voice, what you say, and any details you provide (for example, appointment or contact information)—is processed to answer and route the call, take messages, and provide summaries to that business.
For these calls, Fluid AI processes information on behalf of its business customer, which decides how call data is used and retained. Questions or requests about a specific business’s calls should be directed to that business; we will assist our customers in responding. Business customers are responsible for providing any notices and obtaining any consents required by law for call recording and AI interaction in their jurisdictions. TRAK does not use customers’ call recordings or transcripts to market to callers.
Calls with TRAK itself may also be recorded for quality, training and record-keeping, with notice where required by law.
8. Data retention
We keep personal information only as long as reasonably necessary for the purposes described here—for example, to respond to your request, provide services, maintain business and financial records, resolve disputes and meet legal obligations. Inquiries and applications that do not result in a relationship are deleted or de-identified when no longer needed. Fluid AI call recordings and transcripts are retained according to the settings and instructions of the business customer and our agreement with them. Server logs are kept for a limited period for security and troubleshooting.
9. Security
We use reasonable administrative, technical and physical safeguards, including encrypted HTTPS connections and access limits, to protect information. However, no internet transmission, email or storage system is completely secure, and we cannot guarantee absolute security. Please avoid sending sensitive financial or identity information by email.
10. Your choices & rights
- Access, correction and deletion. You may ask us to tell you what personal information we hold about you, correct it, or delete it, subject to legal and contractual exceptions (for example, records we must keep, or information already provided to a processor or lender at your direction).
- Marketing email (CAN-SPAM). You can unsubscribe from marketing emails at any time using the link in the email or by contacting us. We will still send transactional messages about your application, account or services.
- Calls and texts (TCPA). We will only place marketing calls or texts using automated technology or prerecorded/artificial voices with your prior express consent where required. Consent is not a condition of purchase. You can opt out of texts by replying STOP, and ask us to stop calling you at any time. Message and data rates may apply.
- State privacy rights. Depending on where you live (for example, California under the CCPA/CPRA), you may have rights to know, access, correct and delete personal information, to opt out of sale or sharing (we do not sell or share it), to limit use of sensitive information, and not to be discriminated against for exercising these rights. You may use an authorized agent. We will verify requests before acting on them.
- Browser controls. You can block or delete cookies in your browser settings; strictly necessary cookies are required for sign-in.
To make a request, email privacy@trakgrowth.com. If your information was collected by a Fluid AI customer on its own behalf, we may refer you to that business.
11. Children
Our websites and services are intended for businesses and adults. They are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.
12. Changes to this policy
We may update this policy from time to time. We will post the updated version on this page with a new effective date and, for material changes, provide additional notice where appropriate.
